Provides comprehensive regulations governing safety in mining operations in 17 Parts. Part 2 governs the designation of employee's inspectors, health and safety representatives, and the issuing of certificates of competency for managers. Division 4 of Part II provides for a Mines Occupational Health and Safety Advisory Board. Part 3 regulates matters relating to the management of mines, including the inspection of the workplace and the provision of health surveillance. Part 4 provides general safety requirements, including the maintanence of first aid equipment and an emergency plan. Part 5 governs the use of electricity in mines. Part 6 regulates the use of certain types of plant in mines. Part 7 governs matters relating to occupational health in mines, including noise control, sanitation, and hazardous substances. The use of explosives and the control of dust are treated in Parts 8 and 9. Part 10 provides specific regulations, inter alia prohibiting persons under 18 from working underground and requiring underground workers to read and speak English. Part 11 through 15 relate to specific mining operations such as dredging and shaft sinking. Part 16 governs radiation safety. Made under Mines and Safety Inspection Act 1994.

Sections 28-35 provide for notification of serious bodily injury, work-related illness or dangerous occurrences, immediate notice concerning death, codes of practice, and for the ad hoc establishment of an Accident and Enquiry Tribunal. Part IV is entitled "Authority and Council", Part V "Industry Workplace Health and Safety Committees", Part VII "Appeals Tribunal", and Part X "Legal Proceedings".

This Act establishes the South Australian Occupational Health and Safety Commission, which is empowered, inter alia, to formulate and promote policies and strategies for the improvement of occupational health, safety and welfare, to prepare codes of practice, to keep under review the enforcement of regulations and standards in the field and the role of health and safety representatives, and to devise, promote or approve training courses (s. 14). Part III contains general provisions relating to occupational health, safety and welfare (duties of employers, workers, manufacturers, etc.), and Part V sets forth the powers of entry and inspection. Provisions governing health and safety representatives and committees at the workplace are encompassed by Part IV; their functions include inspection, accompanying inspectors, investigating complaints and being consulted by the employer. Such representatives may, under certain circumstances, issue default notices or order that work cease (ss. 35-37). Amendments to the Industrial Conciliation and Arbitration Act 1972 and the Mines and Works Inspection Act 1920 are noted in a Schedule to the Act; the Industrial Safety, Health and Welfare Act 1972 is repealed.

The Act establishes the Occupational Health and Safety Commission as a consultative body responsible, inter alia, for promoting education and training in the field of occupational health and safety, and making recommendations to the Minister with respect to the elaboration of the regulations to be introduced under the Act. It furthermore prescribes procedures for protection, consultation and, if necessary, the interruption of work in the event of a threat to health and safety in an undertaking. Following negotiations between the employer and the trade union concerned, the workers may elect health and security representatives at the workplace, whose functions are also specified in the Act. The Act provides for an inspection scheme covering occupational health and security, and inspectors are to be appointed by the Minister and vested with extensive powers. The Act repeals the Industrial Safety Health and Welfare Act, 1981, and contains amendments to eight other statutes.

This includes prosecutions, evidentiary prosecutions and penalties for offences. Part Eight sets miscellaneous regulations.
