Tout en préservant au citoyen ses recours de droit commun, cette loi confère au Tribunal des droits de la personne une compétence pour entendre toute demande de la Commission des droits de la personne en matière de discrimination et d'exploitation. Elle lui confère également compétence en matière de programmes d'accès à l'égalité. Ce texte modifie, par ailleurs, la Charte des droits et libertés de la personne (L.R.Q., chap. C-12) en ce qui concerne les dispositions relatives au traitement des plaintes adressées à la Commission et instaure, à cet égard, de nouveaux mécanismes d'enquête et de règlement des différends, dont celui de l'arbitrage. Il permet la délégation de certaines responsabilités de la Commission à un comité des plaintes formé de trois de ses membres. Enfin des dispositions visent à faciliter la mise en oeuvre des nouveaux mécanismes d'application de la Charte.

Numerous amendments of the Canada Labour Code regarding matters including votes on employer's last offer during a strike, and definitions of "collective agreement", "qualified medical practitioner", "standard hours of work" and "regional director". Sets out procedures for modification of work schedules by employers, and circumstances where maximum hours of work under the Code may be exceeded by ministerial permit. Allows substitution of any other holiday for a general holiday if approved by 70 per cent of the affected employees. Amends extensively provisions regarding maternity-related reassignment, maternity leave and parental leave, and work-related illnesses and injuries. Amends the Public Service Labour Relations Act to provide that during a strike a Minister may order a vote by employees on acceptance of the last offer made by the employer during collective bargaining.

Aims to provide equality in the workplace so that no person shall be denied employment opportunities and to correct conditions of disadvantage in employment experienced by women, aboriginal peoples, persons with disabilities and members of visible minorities (s. 2). Applies to private sector employers and specified portions of the public service (s. 4). Employers shall identify and eliminate employment barriers against persons in designated groups and institute policies which ensure that designated groups achieve a degree of representation in the workforce. The measures do not require the employer to hire unqualified persons or create new positions (s. 6). Section 7 provides that if an employer is engaged primarily in serving aboriginal peoples, he or she may give preference to hiring aboriginal peoples, unless this would constitute a discriminatory practice under the Canadian Human Rights Act. Employers shall prepare an employment equity plan setting forth measures which will be taken to correct any deficiencies in the representation of designated groups (s. 10). S. 18 requires every private sector employer to file an annual report detailing the number of persons from designated groups represented in the workforce, as well as their salaries and occupational groups. S. 21 requires a similar report from the President of the Treasury Board concerning employment of designated groups in the public service.
Part II delegates power of enforcing the Act to the Canadian Human Rights Commission, and provides regulations thereto. Monetary penalties for violation of the Act are set forth in Part III.

Establishes an Employment Equity Commission that may conduct audits of employers to determine whether they are complying with their obligations under Part III of the Act.

The Act aims at achieving equality in the work place and, in fulfilment of that goal, at correcting the conditions of disadvantage in employment experienced by women, aboriginal peoples, persons with disabilities and persons who are, because of their race or colour, in a visible minority in Canada. It imposes a duty on employers, in consultation with employees' representatives, to implement employment equity by (a) indentifying and eliminating practices resulting in employment barriers and (b) instituting positive policies and practices and making reasonable accommodation to ensure that persons in designated groups achieve a proportionate degree of representation in the various positions of employment with the employer. The Act calls upon employers to prepare a plan including goals and timetables and to file reports, copies of which go to the Canadian Human Rights Commission.

Réforme l'ensemble du processus de contestation des décisions rendues en vertu de la Loi sur les accidents du travail et les maladies professionnelles et de la Loi sur la santé et la sécurité du travail. La Commission des lésions professionnelles a pour fonction d'examiner et de statuer sur les contestations des décisions rendues par la Commission de la santé et de la sécurité du travail, à la suite d'une révision administrative. Prévoit que la Commission comporte deux divisions, celle du financement et celle de la prévention et de l'indemnisation des lésions professionnelles. Modifie également le processus d'évaluation médicale du travailleur victime d'une lésion professionnelle en permettant au médecin en charge du travailleur de produire un rapport médical complémentaire lorsqu'il y a divergence d'opinion entre ce dernier et le professionnel de la santé ayant examiné le travailleur à la demande de l'employeur.

Définit la notion de salaire brut d'un travailleur et prévoit, aux fins du calcul de la cotisation des employeurs, la prise en considération de ce salaire jusqu'à concurrence du maximum annuel assurable. Modifie le délai avant lequel un employeur doit produire son état annuel des salaires et verser sa cotisation.

Les modifications visent essentiellement à instaurer une nouvelle structure de classification des employeurs et un nouveau mode de tarification de ceux-ci. Sont également prévus l'ajout à la cotisation des employeurs d'une somme de défrayement pour dépenses inhérentes à la gestion des dossiers, l'effectivité immédiate de tout avis d'imputation, malgré une demande de révision ou un appel, ainsi que de nouveaux pouvoirs règlementaires en matière de financement pour la Commission de la santé et de la sécurité du travail.

Cette loi a pour objet de déclarer valides des programmes de stabilisation sociale, de stabilisation économique et d'indemnités de réadaptation établis par la commission de la santé et de la sécurité du travail en application de la Loi sur les accidents du travail. De plus, il prévoit que la commission peut, par réglement, modifier ces programmes. Elle a également pour objet de modifier, avec effet rétroactif, la loi sur les accidents du travail afin de prévoir les modalités de remboursement, par les employeurs visés à l'annexe B de la loi, des dépenses et déboursés effectués par la commission en matière de réadaptation et de supprimer le pouvoir réglementaire qui est prévu à cette fin. Enfin, elle prévoit le processus de révision et d'appel des décisions prises par la commission pour l'application des ces programmes ainsi que les modalités de remboursement des sommes que les employeurs ayant contesté les programmes ont dû payer en application de ceux-ci.

La présente loi ne porte pas atteinte aux dispositions de la loi sur l'indemnisation des victimes d'actes criminels; elle entraîne des modifications de concordance dans vingt autres lois.
Le but de cette loi est d'instituer un nouveau régime d'indemnisation des lesions professionnelles qui remplace les régimes prévus dans la loi antérieur sur les accidents du travail et la loi sur l'indemnité des victimes de amiontose ou de silicose dans les mines ou carrières. Définit la notion de lésion professionnelle comme la blessure ou la maladie causés par un accident de travail ou une maladie professionnelle, comme cité à l'appendix I. Donne aux travailleurs victimes d'une lesion le droit à des prestations d'indemnités, de réadaptation et d'asistance médicale ainsi que le droit d'être incorporé au travail avec le même employeur. Le nouveau régime est applicable à tous les travailleurs victimes d'une lésion dans le territoire du Québec et sous certaines conditions, les travailleurs du Québec victimes en dehors du Québec. L'administration du nouveau régime est soumise à la Comission de la santé et la sécurité du travail, qu'administre son financement et decide quant aux réclamations sous contrôle judiciaire.

Cette loi a pour objet de modifier la Loi sur la santé et la sécurité du travail (SL 1979.Can.1) afin de permettre l'application, au Québec, d'un programme national d'information sur les matières dangereuses utilisées au travail. Elle crée de nouvelles obligations aux employeurs à l'égard de certains produits qui peuvent constituer un risque pour la santé et la sécurité des travailleurs. L'employeur est tenu de fournir à ses travailleurs certaines informations au moyen d'étiquettes, de fiches et d'un programme de formation et d'information. L'employeur peut cependant, à certaines conditions, être exempté de l'obligation de divulguer sur une étiquette ou une fiche des informations de nature confidentielle en soumettant une demande d'exemption à un organisme désigné par le gouvernement. La décision rendue par celui-ci peut faire l'objet d'un appel.

This Act amends several provisions of the Labour Code, concerning in particular the definition of hazardous substances (Part II, s. 3) and the obligations they imply for employers (Part II, s. 5). It also amends the Hazardous Products Act, especially regarding methods of manufacturing and preparing such products (containing an amended appendix listing the categories of products in Part I). The amendment promulgates (in Part III) the Hazardous Materials Information Review Act, which establishes a system of review and appeals of decisions taken by screening officers. The new Act sets up the Hazardous Materials Information Review Commission (Part III, ss. 28 et seq.), which includes two workers' representatives.
