The Immigration Nursing Relief Act of 1989 was enacted to provide relief
for the nursing shortage crisis. Subpart D of these Regulations set forth
the procedure by which health care facilities seeking to use nonimmigrant
registered nurses may submit attestations to the Department of Labor relating
to the effects on the nursing shortage on their operations, their efforts
to recruit and retain United States workers as registered nurses and certain
information on wages and working conditions for nurses at the facility.
Subpart E of these Regulations set forth complaint, investigation and
penalty provisions with respect to such attestations.

Raises the annual immigration quota by 40 per cent, to some 700,000,
with a large proportion of the extra visas being granted to skilled people
without family ties in the United States, subject to education and work
experience requirements. The Act repeals earlier provisions specifically
restricting admission to the United States on grounds of political opinion,
H.I.V. infection, etc. The anti-discrimination features of the Immigration
Reform and Control Act of 1986 are strengthened, and the "temporary
protected status" is instituted as a form of relief for aliens unable
to return to their country due to war, natural disaster, etc.

Amends the Immigration and Nationality Act in various respects.
Inserts a new section 274A (8 USC 1324) to make unlawful the recruitment
or referral for employment of unauthorized aliens.
The Act also establishes an employment verification system to ascertain
that a person is not an unauthorized alien. Violations are subject to
an order to cease and desist and to pay civil penalty.
A new section 274B prohibits discrimination based on national origin or
citizenship status as being unfair immigration-related employment practice,
and establishes a complaints procedure for a person to obtain redress
therefor.
The Act further contains new provisions governing temporary agricultural
workers and special agricultural workers (Title II, Part A of the amendments).
In addition, it denies admission to the United States alien crewmen for
the purpose of working on board a vessel or aircraft at the time of a
strike (section 315 (d) of the amendments). Further, illegal aliens who
have lived in the United States continuously since 1 Jan 1982 may apply
for legal status.

Protection Agency to promulgate regulations requiring inspection for asbestos-containing
material in educational institutions, and related matters. Provides, inter
alia, that inspection for asbestos-containing material in school buildings
and performance of response actions (e.g. removal, etc.) may be engaged
in only by persons who have been accredited upon passing an examination
and pursuing continuing education courses on the subject. The examination
covers hazard identification, the use of personal protective equipment,
appropriate work practices, medical surveillance programme requirements,
and related topics. Employees who provide information relating to a potential
violation of this Title are protected against discharge or other discrimination
(s. 211). The Act sets forth the relationship between local, state and
federal governmental bodies as to its implementation and enforcement.

Extends and amends the Comprehensive Environmental Response, Compensation
and Liability Act of 1980 (the "Superfund Act"). Section 126
calls upon the Secretary of Labour to promulgate standards for the health
and safety protection of employees engaged in hazardous waste operations.
Such regulations shall include provisions regarding training, medical
surveillance, protective equipment, maximum exposure limits, requirements
for the handling, transporting, labeling and disposing of hazardous wastes,
inter alia. The Act also governs civil actions by individuals, imposes
