Since the Association of vehicle
operators had decided to help its member companies to comply with the statutory
requirements under §§ 5 and 6 of the Law on occupational health and safety
immediately the Law on occupational health and safety entered into force on 21
August 1996, it was appropriate that the Association‘s Technical supervision
department should participate in this project sponsored by the European
Commission.
Now that the
project has been completed, we are in a position to offer you this Guide;
although it is geared exclusively to the German regulations on occupational
health and safety and accident prevention, it can be seen at the same time as a
contribution to further harmonisation of occupational health and safety
requirements in the European Union.

Introductory comments
1. What
is the legal basis for the identification and assessment of occupational
hazards?
The statutory requirement ensues from §
5, Law on occupational health and safety (ArbSchG)
§ 5 ArbSchG
Assessment of working
conditions
(1) The employer must determine what occupational health and safety
measures are required by assessing the hazards to which employees are exposed
in the context of their work.
(2) The employer must carry out the assessment according to the nature
of the activities. Where working conditions are the same in all cases, an
assessment of one workplace or one activity is sufficient.
(3) A hazard can ensue from the following in particular:
1.
the design and fitting out of the place of work and the individual workstation,
2.
physical, chemical and biological influences,
3.
the design, choice and utilisation of the means of work, in particular working
materials, machinery, equipment and plant and their handling,
4.
the design of work and production processes, the flow of work and working
hours, and their combined effects,
5.
inadequate skills on the part of and instruction of employees.
Explanatory
notes on § 5:
This
paragraph implements Article 6 … of the Framework Directive*.
The
health and safety measures required can be identified only on the basis of an
assessment of working conditions.
This
includes identifying a hazard as such and assessing how serious it is (nature
and extent of the potential harmful effects). The requirements for the
assessment are dependent on the nature of the activities.
It
is permissible for the employer to carry out an assessment only once when all
working conditions are the same because, in this case, it can be justifiably
assumed that the result of the hazard assessment will be capable of comparison.
This
also makes it possible to use standard assessments for typical fields of work.
Paragraph 3 contains a list of specimen working conditions which can give rise
to hazards for employees.
The
list serves as a reference point for the hazard assessment to be carried out by
the employer.

2. Do
all employers have to identify and assess hazards and document the results?
The Law on occupational health and safety serves to
safeguard and improve the health and safety of employees in the workplace by
means of occupational health and safety measures. “Employees“ are those persons
who perform work on the basis of a legal relationship with the employer
(contract of employment, inter alia).
It stipulates that all employers, irrespective of the number
of employees they have, must carry out a so-called hazard analysis, i.e.
identification and assessment of occupational hazards/burdens.
In addition, under § 6 of the Law on occupational health and
safety the employer must have in his possession documentation showing the
result of the hazard assessment, the occupational health and safety measures he
has laid down, and the result of a review of the latter.
Only employers with ten employees or fewer are
exempt from the obligation to hold documentation, and then only in so far as
not otherwise stipulated in other regulations.
The persons responsible within the company and the competent
supervisory bodies have to rely on having documentation which informs them, in
particular, of the result of the hazard assessment, what health and safety
measures have been implemented, and whether and with what result their
effectiveness has been reviewed.
The employer is obliged to keep the relevant documentation
available.
In this context, the employer is able to choose how he
fulfils this obligation to keep records.
He does not necessarily have to keep separate records for
each individual workplace.
Details of the documentation may be laid down at a lower
legislative level, in accident prevention regulations specific to a sector or
in a general regulation, in so far as the need arises.
It follows from the meaning and purpose of the obligations
in respect of documentation that the records available must always be up to
date.
This means that “old stocks“ of records do not need to be
retained for a lengthy period, but only for as long as is necessary in order
that the current records can be fully understood.
3. What
obligations is the employer under in respect of ensuring occupational health
and safety?
Thus under § 5 ArbSchG, the employer is obliged to implement
the necessary health and safety measures which take account of all circumstances
affecting work. He has to review the effectiveness of the measures and, if
necessary, to adapt them to changes in circumstances.
The aim is to prevent accidents at work and work-related
health hazards, with the participation of employees. This necessitates a
targeted and systematic identification and assessment of the hazards/burdens to
which employees are exposed.
The traditional view of hazard assessment was geared to
accident hazards caused by technical defects. The current view is that this way
of looking at the situation is no longer adequate. Occupational health and
safety need to be considered in a holistic way, which includes the physical and
psychological demands imposed by work. Only in this way is it possible to
prevent injury being done to health, which leads in the end to work-related
illnesses.
4. Motivating
factors for the employer
Companies are now more than ever subject to economic
constraints. It is essential for them to reduce costs and at the same time to
increase the quality of their products or services, if they are to be
successful. Accidents and work-related illnesses, downtime for machinery and
plant, expensive repairs and defective products all work against this.
A corporate philosophy geared to success is characterised by
the fact that it integrates occupational health and safety. This applies just
as much to medium-sized and large companies as to small companies.
It is crucial for a company geared to quality to take into
consideration not only its products and the services it offers, but also the
work process. Occupational health and safety and health-promotion measures help
to determine the quality of the work process. In this context, preventive
measures are particularly important.
The basis for preventive measures is an assessment of all
aspects of work in respect of the risk they pose to the safety and health of
employees.
5. What
basic concepts need to be clarified, and how are they defined?
Hazards are characterised by the fact that harmful forces or
substances (e.g. an electric current, grit) may coincide with a human being in
terms of space and time, which means that there is a possibility of injury to
health.
Risk
refers
to the degree of probability and severity of an injury which may be caused by a
hazard.
Burden [Belastung] refers to all external
conditions and demands/requirements in the system of work capable of altering a
person‘s physical and/or psychological state.
Stress
[Beanspruchung] is the effect of the
burden on an individual, and is dependent on the individual‘s own
characteristics and capacities.
Work
content means the work requirements in their entirety, as they ensue
from the job instructions given to an individual and from that person‘s working
conditions.
Activities
are part of the job instructions and are characterised in each case by the
means of work required (e.g. grinding, drilling, lifting and carrying of loads,
handling of hazardous substances).
6. When
is it necessary to identify and assess hazards/burdens?
Hazards/burdens
are identified and assessed
·
as a first assessment at existing workplaces,
·
at regular intervals, especially when regulations are
amended and/or there are changes in respect of the level of technology,
·
if there is a major expansion in or modification of the equipment
used,
·
if there is a major change in the utilisation of equipment,
·
before new machinery and production equipment is procured,
·
in the event of fundamental changes in work organisation,
and
·
after the occurrence of accidents at work, near-accidents and
illnesses.
2. Who
can implement the identification and assessment of occupational
hazards/burdens?
The
identification and assessment of occupational hazards and burdens can be
carried out either by the employer himself or by
·
management staff
·
industrial safety specialists
·
company doctors
·
other specialists
commissioned
by the employer.
In
principle, it is advisable to form a team of people from the above categories,
together with the employees concerned and, if applicable, the works council, to
carry out the identification and assessment of occupational hazards/burdens.
2. Who
can provide advice, and who is in overall control?
The staff of the Technical supervision department of the
relevant professional association are available to provide advice on implementing
the identification and assessment of occupational hazards/burdens.
The employer is responsible for controlling implementation
of the measures required, and the competent official body is responsible for
controlling the documentation (in so far as this is required).
3. How
are the objectives of protection identified?
Objectives of protection are expressions of safety
requirements and standards, i.e. they describe the standards required for
machinery/plant and processes/procedures. The overall objective of protection
is freedom from danger.
If objectives of protection are formulated in regulations,
accident-prevention regulations and standards, they are binding and are
described as standardised [normiert] objectives of protection. If objectives of
protection have not been standardised, it becomes necessary to carry out a risk
assessment.
4. Purpose
and requirements of the hazard assessment
The hazard assessment serves as a model
guide for the independent implementation by the employer of an assessment of
working conditions. It involves both the identification of possible hazards and
the initiation of measures to eliminate or at least minimise these hazards, and
the documentation and review of the efficacy of the measures selected. In
addition, the hazard assessment provides help in selecting and implementing
appropriate preventive measures.
5. Structure
and organisation of the hazard assessment
The hazard assessment provides for identification and
assessment of occupational hazards/burdens specific to a particular industry or
occupation. It is structured in accordance with risk factors, subdivided into
technical factors and aspects relating to organisation and conduct. Its extent
is approximately proportional to the risk of accidents and illnesses and the
complexity of the trade/business specific to that particular industry. This
means that the overall extent is considerably less in low-risk occupations and
industries than in high-risk occupations and industries.
This guide should be seen not as a set of instructions, but
only as an aid that has, moreover, been kept very general. Naturally this
enables the employer to take particular account of aspects specific to his
company.
12. Procedure
for implementing the hazard assessment
The employer must identify the hazards and burdens to which
employees in his company are exposed.
This may mean that it is necessary for him not simply to look at an
area of activities within the company, but at individual workplaces or even
individual activities within that area.
On the other hand, in § 5 ArbSchG [Law on occupational
health and safety], the legislator stipulates that, where working conditions
are the same in all cases, an assessment of one workplace or one activity is
sufficient.
In order to assist companies in the furniture removal
industry to record working conditions that are the same in all cases, this
hazard assessment is organised on the basis of a “matrix
solution“.
This “matrix solution“ includes a
summary, “classification of hazard/burden factors“, which lists all the data
sheets that could be useful in carrying out the hazard assessment. However, the
key elements of the matrix solution are the hazard matrices, in which the
hazards/burdens to be included in respect of the workplaces/activities actually
found in the company can be recorded. Here, the employer can summarise all the
workplaces/activities before he actually carries out the hazard assessment,
using the examples provided, and can establish what burdens, problems or
hazards need to be investigated in each case. The employer can also utilise the
solutions for typical workplaces and activities in companies in the furniture
transport industry, which have already been summarised as far as possible. He
needs only to supplement them in areas in which the typical workplace/activity
differs from the workplace/activity that actually exists in his company.
Thus there is no need to check all conceivable hazards and burdens via a generalised checklist. A hazard assessment appropriate to the purpose limits itself to and concentrates on the burdens/problems/hazards of relevance to the workplace or activity concerned in practice.
Once
the form “Record of data for company and work organisation“ and the relevant
“hazard matrices for recording data on the workplace and/or the activity“ have
been completed, and the data sheets in section C relating to the hazard
matrices have been found and worked through, these documents must be collected
together as shown on the next page.
This
collection of documents both constitutes and serves as a record of the
completed hazard assessment.
The diagram below shows what the collection of
individual data sheets, with the hazard matrix and the sheet for recording data
on the company and on work organisation, might look like:

The hazard assessment, as compiled in this way, can
be used as proof, i.e. as documentation within the meaning of § 6 ArbSchG [Law on occupational health
and safety], in respect of the workplace/activity identified.

Second step: use the “summary of
hazards/burdens“ to determine the hazards/burdens to be included in respect of
the relevant workplace or the activity.
Third step: in the matrix, mark with a
cross (x) the numbers representing hazards/burdens that need to be included.
Fourth step: Find the data sheets that
correspond to the numbers, and photocopy them if you want to keep the original
version of the hazard assessment..
Fifth step: work through the data
sheets as described in section C.
In the
example, which uses the activity “furniture handler, packer“, crosses have been
marked in to indicate which numbers in the “summary of hazards/burdens“ need to
be worked through in the hazard assessment.

question of what hazards/burdens/problems actually need to be taken into
account by the employer depends exclusively on the conditions in his own
company.
Once
these data sheets have been worked through, they must be collected together as
shown in the diagram on the previous page. This collection of data sheets shows
the situation with regard to safety in the workplace “flats, vehicle, company
premises, furniture warehouse“ or, if applicable, how it has been made safe.

C. Data sheets for assessing occupational hazards and burdens in
accordance with § 5, Law on occupational health and safety
If an employer
uses this guide to help him in assessing hazards, he will be working in a
targeted way and minimising the effort and costs involved.
By using this
guide, he will create the necessary transparency in his company and will show
his employees that he is taking their health and safety seriously.
If an employer
proceeds systematically in accordance with this guide, it will be easier for
him to prove to the supervisory authorities that he has fulfilled his
responsibilities under the Law on occupational health and safety.
If he uses the
data sheets that follow, he will be able to identify the occupational hazards
and burdens to which his employees are exposed, and to assess what occupational
health and safety measures are required in order to eliminate or, if this is
not possible, at least to minimise these hazards and burdens. It will also be
possible for the employer to review the efficacy of the measures he adopts and
to document this review, too.
The checklists
are divided into five columns:

Possible hazards are listed in the first column, with
reference to the hazard and stress factors cited in § 5, Law on occupational
health and safety.
·
Column 2 lists possible causative situations or equipment,
products or problems, and contains specific questions or pointers with
reference to the factors, in order to make it easier for an employer to
recognise hazards that may be relevant to his company: e.g. if employees are
permanently exposed to noise. He indicates in this column the hazard or problem
he has identified.
·
The employer uses column 3 to specify how the measures he
has chosen are to be implemented, in order to eliminate the hazards or problems
identified. Examples of possible measures are listed in column 4. The employer
can also evaluate the efficacy of the measures he has initiated and, if
necessary, adopt further measures.
·
Column 4 contains measures tried and tested in practice,
from which the employer can select the one he considers to be suitable for
eliminating or at least minimising the hazard identified. This measure should
be cited in column 3. It is also open to him to select measures other than
those suggested. However, if he selects measures other than those cited in the
regulations (e.g. regulations implementing the Law on occupational health and
safety, accident prevention regulations, ZH 1 documentation), he is obliged to
estimate whether the risk involved in the measure he has selected is less than
or equal to the acceptable risk. A risk is acceptable if, the greater the
extent of harm or damage, the less probable it is that harm or damage will
occur.

Column 5 lists references to further information and
regulations.
These
data sheets should not be seen as a definitive summary of all the
hazards/burdens to be found in the workplace, but simply as an indication of
how the identification and assessment required can be carried out. The data sheets
should be supplemented as appropriate, according to the particular workplace
and the conditions in that workplace.
