Immediately after the German Health and Safety at Work Act came into force on 21 August 1996, the German trade association with responsibility for safety and insurance in undertakings specialising in the keeping of vehicles (the Berufsgenossenschaft für Fahrzeughaltungen or BGF) decided to assist its member undertakings to meet the statutory requirements of Sections 5 and 6 of the Act. It was obvious, therefore, that the BGF’s technical advisory service (Technischer Aufsichtsdienst or TAD) should participate in this project sponsored by the European Commission.
Now that the project is complete, we
are in a position to made this Guide available to you. Although it is based
exclusively on the German health and safety at work regulations, it can also be
regarded as a contribution to further harmonisation of health and safety at
work requirements within the European Union.

A. Introductory
remarks
1. What
is the statutory basis for identifying and assessing work-related hazards?
The
statutory basis can be found in Section 5 of the German Health and Safety at
Work Act (HSW Act)

HSW Act
Assessment of working conditions
(1) The employer shall identify the health and safety measures
required by assessing the work-related hazard to workers.
(2) The employer shall carry out the assessment according to the
nature of the activities. Where working conditions are very similar, it shall
be adequate to assess one work place or activity.
(3) A hazard may result, in particular, from
1. the way the work place and job is designed and
equipped,
2. exposure to physical, chemical and biological
factors,
3. the design, choice and use of equipment, in
particular of materials, machinery, tools and plant and the handling thereof,
4. the design of working and production methods,
workflows and working time and the interaction thereof,
5. workers being underqualified or not being
given adequate instructions.
Notes on Section 5:
This paragraph
implements Article 6 .... of the framework Directive *).
The safety
measures required can be identified only by assessing working conditions.
This includes
recognising a hazard as such and assessing its severity (the nature and extent
of possible harm). The precise assessments required will depend on the nature
of the activities.
Where working
conditions are very similar, the employer may make only one assessment because,
in such a case, it is legitimate to presume that the findings of the hazard
assessment will be comparable.
The use of
standard assessments for typical fields of work is also made possible by this.
Sub-section 3 contains a list of examples of working conditions which may
constitute a hazard to workers.
The list
serves as a starting point for the hazard assessment to be carried out by the
employer.

2. Must
all employers identify and assess hazards and then document the findings?
The purpose of
the German HSW Act is to safeguard and improve the health and safety of workers
at work by means of health and safety measures. “Workers” are those who do work
on the basis of a legal relationship with an employer (e.g. an employment
contract).
This means
that, irrespective of the number of workers, all employers must carry out a
hazard assessment, that is to say, must identify and assess work-related
hazards/stress factors.
Under Section
6 of the German HSW Act, employers must also be in possession of documents
recording the findings of the hazard assessment, the health and safety at work
measures they have specified, and the results of their review.
Employers
with ten workers or less are exempt from the duty to be in possession of
documentation, but only if other legislative provisions do not specify
otherwise.
Those
responsible in the undertaking and the agencies responsible for monitoring are
reliant on documents providing, in particular, information on how the hazard
situation is assessed, the safety precautions taken, whether their
effectiveness has been reviewed and, if so, with what results.
Employers are
under an obligation to allow access to appropriate documents.
Employers are,
however, at liberty to decide how to comply with this duty to provide
documentation.
They do not
necessarily have to keep separate documents for each individual work place.
Details
concerning the documentation may be enshrined in safety regulations governing a
particular sector or more generally in a statutory instrument, if such a need
arises.
It is evident
from the purpose of the duty to provide documentation that documents on the current
situation must always be available.
Earlier
documents do not therefore need to be kept for a lengthy period but only as
long as they are needed to shed light on the current documents.
3. What
are the employer’s duties in guaranteeing the health and safety of workers at
work?
Under Section
5 of the German HSW Act, employers are therefore under an obligation to take
the necessary measures to protect health and safety with due regard for all the
circumstances at work. They must review the effectiveness of the measures and
make adjustments to changes of circumstances where necessary.
The objective
is to involve workers in the prevention of accidents at work and in the
avoidance of work-related health risks. This involves selectively and
systematically identifying and assessing the hazards/stress factors to which
workers may be exposed.
Hazard
assessment was traditionally concerned with accident hazards posed by technical
problems. This approach is no longer adequate today. Health and safety at work
now has to be regarded in its entirety, including the physical and mental requirements
of the job. This is the only way to prevent impairment to health, which
ultimately leads to the occurrence of occupational diseases.
4. Factors
to motivate employers
Undertakings
are subject to economic constraints, now more than ever before. Success depends
above all on cutting costs and improving the quality of the products produced
or services provided. Success is hindered by accidents and occupational
diseases, machinery and plant breakdowns, costly maintenance work and faulty
products.
A successful
corporate philosophy includes worker health and safety. This applies both to
medium-sized and large operations as well as to small ones.
It is crucial
for an undertaking geared to quality to take into account not only the products
and services offered but also the work process. Worker health and safety and
measures to promote good health help to determine the quality of the work
process. Preventive measures are of particular importance in this context.
The basis for
preventive measures is an assessment of all work-related aspects in terms of
the risk they pose to employee health and safety.
5. Basic
terms and definitions
Hazards
occur where there is the possibility of human contact in space and time with
harmful energy or substances (e.g. electricity, abrasive dust), as a result of
which there is potential harm to health.
Risk is
the likelihood and severity of harm which may be caused by a hazard.
Stress
comprises all the external work-system conditions and requirements which may
affect a person’s physical or mental condition.
Pressure is
the effect of stress on a person according to their individual qualities and
capabilities.
Work content is
understood to mean all the work requirements to which a person is subject as a
result of the work assigned and working conditions.
Activities
are parts of the assignment and are characterised by the equipment required in
each case (e.g. grinding, drilling, lifting and carrying loads, handling
dangerous substances).
6. When
do hazards/stress factors have to be identified and assessed?
Hazards/stress
factors are identified and assessed
·
as an initial assessment at existing workplaces,
·
at regular intervals, particularly when regulations change,
or to adapt to technical progress,
·
if installations are substantially enlarged or converted,
·
if there is a substantial change in the use of
installations,
·
prior to the acquisition of new machinery and production
equipment,
·
in the event of substantial changes to the work
organisation, and
·
after the occurrence of industrial accidents, near-accidents
and diseases.
7. Who
can identify and assess work-related hazards/stress factors?
Work-related
hazards and stress factors may be identified and assessed by employers
themselves or by
·
managers
·
industrial safety officers
·
company medical officers
·
other specialists
acting on
behalf of employers.
It is
generally advisable to form a team from this group, from the employees
concerned and possibly from the Works Council to identify and assess
work-related hazards/stress factors.
8. Who
will give advice and carry out checks?
The staff of
the technical supervisory service (Technischer
Aufsichtsdienst) of the relevant trade association with responsibility for
safety at work and insurance are available to provide advice on identifying and
assessing work-related hazards/stress factors.
Implementation
of the necessary measures is checked by the employer, while the documentation
(where required) is checked by the appropriate authority.
9. How
are the safety objectives to be identified?
Safety
objectives are an expression of safety requirements and specifications, i.e.
they describe the guidelines for machinery/plant and processes. The overall
safety objective is a risk-free environment.
Where safety
objectives are laid down in statutory instruments, safety regulations and
standards, they are binding and are referred to as standard safety objectives.
If safety objectives are not standard, a risk assessment becomes necessary.
10. Purpose
of the hazard assessment and requirements
The
safety check is a guide to enable employers to assess working conditions
themselves. It comprises not only a means of identifying potential hazards and
the introduction of measures to eliminate or at least minimise these hazards
but also the documentation and a review of the effectiveness of the measures
chosen. The safety check is also an aid in the choice of suitable preventive
measures and their implementation.
11. Structure
and arrangement of the hazard assessment
The
safety check is a sector/occupation-specific method of identifying and
assessing work-related hazards/stress factors. It is arranged by risk factors,
divided into technical factors and organisational and behavioural aspects. Its
scope is roughly proportional to the sector-specific risk of accident and
disease and to the complexity of the sector. This means that the overall scope
is much smaller in occupations and sectors where there are few risks than in
those where there are many.
This
Guide is not to be regarded as a set of rules but merely as an aid couched in
very general terms. This, however, enables employers to take suitable account
of the special features of their undertaking.
12. Procedure
for carrying out the hazard assessment
Employers
must identify and assess the hazards and stress factors to which workers in
their undertakings are exposed.
For this purpose, it may be necessary for them to look not just at one operating division but at each individual work place or even each individual activity.
On
the other hand, in Section 5 of the German HSW Act the legislator states that,
where working conditions are very similar, it is adequate to assess one work
place or one activity.
To
enable employers in the area of passenger transport to identify very similar
working conditions, this hazard assessment is based on a “matrix solution”.
This “matrix solution” includes an overview entitled “Summary of hazards/stress factors”, which indicates all the data sheets that could be used for the hazard assessment. Central to the matrix solution are, however, the hazard matrices which enable the likely hazards/stress factors to be recorded for the work places/activities encountered in the undertaking in practice. Using the examples, employers can summarise all work places/activities before actually carrying out the hazard assessment, and they can stipulate which stress factors, problems or hazards must be investigated. Employers can also use the solutions which have already been very largely summarised for typical work places/activities in passenger transport undertakings; these need be supplemented only in the areas in which the typical work place/activity differs from that actually found in their undertakings.
It is not therefore necessary to check all conceivable risks and stress factors by means of a generalised check-list. A more specific hazard assessment is restricted to and concentrates on the stress factors/problems/hazards which occur in the relevant work place/activity in practice.
Once the
“Undertaking and work organisation record” and the relevant “Work place and/or
activity record hazard matrix” forms have been completed, and the data sheets
in Section C have been selected and processed in conformity with the hazard
matrices, these documents must be collated as shown overleaf.
This document
collation shows that the hazard assessment has been carried out and provides
documentation to that effect.
The

When
the hazard assessment has been collated in this way, it can be used as
evidence, i.e. as documentation within the meaning of Section 6 of the German

Second step: Using the “Summary of hazards/stress factors” (see overleaf), identify the hazards/stress factors likely to occur at the specified work place or during the specified activity.
Third step: On the matrix, put a cross by the numbers assigned to the likely hazards/stress factors.
Fourth step: Select the data sheets corresponding to the numbers and copy them if the original hazard assessment sheet is to be retained.
Fifth step: Process the data sheets as described in Section C.
In the example, crosses
indicate the numbers on the “Summary of hazards/stress factors” forms to be
processed during the hazard assessment for the activity described as “Carriage
of passengers”.
After processing, these
data sheets must be collated as shown in the illustration on the previous page.
This collation of data sheets demonstrates the safety situation at the
“Vehicle, depot” work place or, if appropriate, how the work place has been
made safe.

C. Data sheets for assessing work-related hazards
and stress factors as defined by Section 5 of the German Health and Safety at
Work Act
If employers
use this Guide for hazard assessment, they have a clear objective and hence the
procedure takes a minimum of time and money.
By using this
Guide, they create the required transparency in the operations and demonstrate
to the workers that they are taking the matter of their health and safety
seriously.
Use of the
systematic procedure of the Guide makes it easier for employers to provide the
supervisory services with evidence that they have carried out their duties
under the German HSW Act.
The following
data sheets make it possible to identify the hazards and stress factors to
which workers are exposed at work and to assess which health and safety
measures are needed to eliminate these hazards and stress factors or, if that
is not possible, at least to minimise them. Employers are also able to review
the effectiveness of the measures instigated by them and likewise to document
this review.
The
data sheets are divided into five columns:

The first column lists possible hazards based on the hazards
and pressures referred to in Section 5 of the German HSW Act.
·
The second column lists possible causes in the form of
situations or equipment, products or problems, and contains specific questions
and remarks relating to these factors and designed to make it easier for employers
to identify possible hazards in their operations: for example, whether workers
are permanently exposed to noise. In this column they mark the hazard or
problem they have identified.
·
In the third column, employers state how the measures they
have selected are to be implemented to eliminate identified hazards or
problems. Examples of these measures are summarised in the fourth column.
Employers are also able to assess the effectiveness of the action they have
initiated and to instigate further action where necessary.
·
The fourth column contains a list of tried and tested
measures, from which employers can choose the one they think likely to
eliminate or at least minimise the identified hazard; they then enter this
action in column three. They are also at liberty to choose measures other than
those proposed. If they do choose measures other than those referred to in the
regulations (e.g. statutory instruments relating to the German HSW Act, safety
regulations, ZH 1 documents) they are obliged to assess whether, with the
action they have chosen, the risk is smaller than or equal to the acceptable
risk. A risk is acceptable if, with an increasing amount of harm, the
probability of harm occurring is increasingly small.

The fifth column includes references to further information
and regulations.
These data sheets are not intended to be a final summary of all the
hazards/stress factors to be recorded at the work place but merely a guide to
how these hazards/stress factors can be identified and assessed in the required
manner. Extra data sheets need to be used according to the work place and
conditions at the work place.
